1. Acceptance of terms
By downloading, installing, or using any Whyteboard product — including the Shyne iOS app or the whyteboard.com website — you agree to these Terms of Service. If you don't agree, don't use our products.
2. Description of service
Whyteboard Inc. builds focused mobile apps. Shyne is an iOS app for daily manifestation and intention practice — including intention setting, gratitude journaling, affirmations, and related wellness features. Shyne offers a free trial; continued access may require an auto-renewing subscription purchased through the App Store. Subscription terms are disclosed at purchase.
Shyne is a wellness and intention practice app. It is not medical, financial, legal, or professional advice. It does not guarantee any specific outcome.
3. Your account and data
During setup, Shyne creates an account tied to your email so we can support your subscription and the app experience. Your gratitude journal, intentions, abundance cheque, and affirmation favourites are stored on your iPhone or iPad — we do not upload your journal to our servers.
Some other practice data (such as mood check-ins, daily reflection responses, and 369 practice progress) may be stored in our secure cloud service to support account features. You are responsible for maintaining access to your account credentials. Whyteboard is not responsible for data loss resulting from device failure, software error, account loss, or deletion.
4. Subscriptions and billing
Shyne subscriptions are billed by Apple through your App Store account. Payment, renewal, cancellation, and refunds are governed by Apple's terms. You can manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions.
In-app purchases and subscriptions are also subject to Apple's Licensed Application End User License Agreement. These website Terms of Service apply to whyteboard.com and general use of Whyteboard products; your App Store transaction terms are set by Apple.
5. Acceptable use
You agree not to use Whyteboard products to:
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Harass, abuse, or harm others
- Reverse-engineer, decompile, or disassemble the software
- Resell or sublicense access to the software
6. Intellectual property
The Shyne app, Whyteboard name, logo, and all associated content are owned by Whyteboard Inc. and protected by copyright and trademark law. Nothing in these terms grants you any right to use our trademarks or copyrighted materials without our prior written consent.
Journal entries and content you create in Shyne belong to you. You grant Whyteboard no license to that content beyond what is needed to operate the app and related account features.
7. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHYTEBOARD INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD.
9. Changes to the service
We may update, modify, or discontinue any aspect of our products at any time. We'll make reasonable efforts to notify users of material changes through App Store release notes or in-app notices.
10. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Delaware.
